Terms and Conditions

These terms and conditions are the contract between you and Well-Being Insights Ltd. In this document, “we”, “our”, “us” or “WBI” refer to Well-Being Insights Ltd. By visiting or using WBI’s Website, or signing up for WBI’s Services, you agree to be bound by them.


We are: Well-Being Insights Ltd, a company registered in New Zealand.
You are: Anyone who uses the WBI Website or other WBI Services, or buys from WBI.


These are the agreed terms:

  1. Definitions
    “Content” means the textual, visual or aural content that is encountered as part of your experience on the WBI Website or in other Services provided by us. It may include, among other things: text, images, sounds, videos and animations.
    “Event” means an in-person event for which Tickets are offered for sale on the WBI Website or other websites or sources, such as through Eventfinda or Eventbrite.
    “WBI Website” means any website or service designed for electronic access by mobile or fixed devices which is owned or operated by us. It includes all web pages controlled by us.
    “Post” means place on or into the WBI Website any Content or material of any sort by any means.
    “Ticket” means any Event ticket sold or offered for sale by us on the WBI Website or through other websites or sources, such as Eventfinda and Eventbrite.
    “Course” means any course registration sold or offered for sale by us on the WBI Website or through other websites or sources.
    “Services” means a service or product available from the WBI Website, whether free or charged, or a WBI service or product provided to you through another medium, such as courses, worksheets, workbooks, workshops, seminars social media posts, blog posts, guides, books, forms, webinars, email newsletters, or any other service or product provided by WBI.

2. Basis of Contract
2.1 In entering into this contract, you have not relied on any representation or information from any source except posted on the WBI Website or Course pages.
2.2 You acknowledge that you understand what is included in the price of a Ticket or Course or other Service and you are satisfied that the Ticket or Course or other Service you have selected is suitable and satisfactory for your requirements.
2.3 You acknowledge that you understand that the contents on the WBI website, and contents received through WBI’s products or services, are for informational purposes only and are not a substitute for professional diagnosis, medical treatment or therapy. We do not claim to be a registered medical or healthcare practitioner. Always seek the advice of your physician or other qualified health care provider with any questions you have regarding a medical condition or mental health symptom, and before undertaking any diet, dietary supplement, exercise, or other health programme. Do not disregard professional psychological or medical advice nor delay seeking professional advice or treatment because of something you have read on the WBI Website or read or heard via any of WBI’s Events, Courses, products or Services.

2.4 Unfortunately, we cannot guarantee that every Ticket advertised on the WBI Website or through other websites or sources, such as Eventfinda or Eventbrite, is available. If at any time you pay for a Ticket which is not available, we will refund any money you have paid.
2.5 We may change this agreement and / or the way we provide a Ticket, Course or other Service, at any time. If we do:
2.5.1 the change will take effect when we post it on the WBI Website. You are advised to check this page from time to time.
2.5.2 if you make any payment for Tickets, Courses or other Services in the future, you agree that it will be under the terms posted on the WBI Website at that time.
2.6 When you buy a Ticket or Course registration, in law you buy a personal licence to attend an Event or enrol in a Course. We may revoke that licence at any time. If that happens you are entitled only to the return of money paid.
2.7 To discourage unfair practices, we will not sell to you more than a maximum number of Tickets for an Event. That number varies from one Event to another.
2.8 We may restrict sales to a maximum number of Tickets per person, per group or per credit card.
2.9 You may not resell any Ticket, Course or other Service provided by us. If you do, or attempt to do so, we are entitled to cancel all your Tickets, Course registrations or other Service without compensating you.

3. Additional terms
3.1 Breach of these terms and conditions will entitle us to cancel your licence to attend the Event, cancel your registration to a Course, or cancel any other Service provided to you. You may then be requested to leave the Event venue or denied access to the Course materials and platforms. You may also be requested to leave the Event venue or denied access to a Course for unacceptable behaviour.
3.2 When you receive your Tickets or Course registration/login details, please keep them safe.
3.3 If you wish to combine one or more Tickets to an Event with the provisions of other services such as hospitality or accommodation or transport and resell the services as a package, you may do so only with our written permission. This applies also to any other disposal of the package, for example as a promotion or reward.
3.4 You may not use a Ticket or Course or other of our Services for any commercial purpose without our permission. The materials contained on the WBI Website and in the WBI Courses and Events and other Services are protected by applicable copyright and trademark law. Permission is granted to temporarily download one copy of the materials (information or software) on WBI’s Website or Course, and to receive or print one copy of the workbook, worksheets or other materials associated with a WBI Event, Course or other Service, for personal, non-commercial viewing only; however, that you shall not delete any proprietary notices. This is the grant of a license, not a transfer of title, and under this license you may not modify or copy WBI Content or utilize them for any commercial purpose or any other public display (commercial or non-commercial), performance, sale, or rental, decompile, reverse engineer, or disassemble WBI Content, or transfer WBI Content to another person or entity or ‘mirror’ the materials on any other server.
3.5 We may change the programme for an Event for circumstances beyond our reasonable control.
3.6 You must present your Ticket in order to gain admittance to the event. The code on the ticket uniquely identifies this ticket and can be redeemed only once.
3.7 If you fail to clear a security search, we may refuse your entry into the Event venue. Because you would be in breach of your implied obligation to behave in an acceptable way, no money will be refunded.
3.8 You must not use photographic or recording equipment at an Event or within a Course or other Service without prior written consent from us. If you do, you accept that we can destroy the media on which they are made or recorded.
3.9 We accept no responsibility for your personal property at an Event or through receiving or using any of our Services.
3.10 If you violate these terms, we may terminate your use of the WBI Website and other Services, bar you from future use of the WBI Website and other Services, and/or take appropriate legal action.

4. Your account and personal information
4.1 When you visit the WBI Website or a WBI online course, you accept responsibility for any action done by any person in your name or under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.
4.2 You agree that you have provided accurate and up to date, information about you. We are not responsible for any error made as a result of such information being inaccurate.

5. The price, payment and delivery
5.1 The price payable for a Ticket, Course, or other Service is clearly set out on the WBI Website and other mediums or sources of purchase, such as eventfinda.co.nz. Prices are inclusive of any applicable goods and services tax or other sales tax.
5.2 You are required to pay in the currency in which the Ticket, Course, or other Service is listed for sale.
5.3 Every sale will be subject to the laws applicable but there shall not be implied any right which is neither a legal right nor set down in these terms and conditions.
5.4 Your Tickets purchased online for an Event will be delivered by your electronic download. Full instructions appear on the website from which you purchased your Ticket as part of the buying process. We advise you check your Tickets immediately on receipt.

6. Security of your credit card
We take care to make the WBI Website safe for you to use.
6.1 Card payments are not processed on a page controlled by us. We use one or more online payment service providers who will encrypt your card or bank account details in a secure environment.

7. Cancellations and refund policy
7.1 You accept that there may be pricing errors on the WBI Website or on other websites or mediums where Event Tickets, Course registrations or other WBI Services are promoted. In the event of a serious under-pricing error, we are not liable to provide Tickets, Course registrations or other purchased WBI Services to you. Your order will be cancelled, and we will refund any money paid.
7.2 We will not accept Ticket returns unless the Ticket delivered to you is not of the Event you ordered at the time of purchase, or we have agreed in correspondence that you may return it.
7.3 If the Event takes place but you do not receive the Ticket you have purchased for any of following reasons, you will be refunded the price you have paid:
7.3.1 if we fail to deliver the Ticket; or
7.3.2 the Ticket has been sent to an address different to the one you specified, and you inform us within a reasonable period, but a replacement Ticket is not delivered.
7.4 WBI genuinely wants you to be satisfied with your Course purchase. If you are dissatisfied with your Course purchase, you have 14 days from the commencement of the course to request a refund. Please email us at admin@wellbeing-insights.com.  We will first attempt to resolve the source of your dissatisfaction.  If the problem cannot be resolved to your satisfaction, we will issue a refund of the Course purchase excluding any payment processing fees. Refunds will be made to your original method of payment.
7.5 Subject to the conditions mentioned in this paragraph and excluding the refund policy for Courses as outlined in 7.4, all monies paid by you to us are non-refundable.

8. Cancellation or postponement of an Event
8.1 Before attending an Event, please check on the WBI Website that an Event is going ahead at the scheduled date, time and venue.
8.2 If an Event is cancelled or we make a significant change to the venue, date, or time, WBI or its ticketing agent will try to inform you. This will usually be by email.
8.3 We will try to help you if an Event is cancelled or changed. You may contact us or our ticketing agent for information relating to:
8.3.1 general information;
8.3.2 seats at any rescheduled Event (subject to availability) up to the face value of the Tickets;
8.3.3 a full or partial money refund, depending on the extent of the change of Ticket.
8.4 In the event of a cancellation, the purchase will be refunded directly to the credit card used for the original purchase.
8.5 If an Event is rescheduled, changed or moved, we will give you the option of either retaining or exchanging the Ticket for the new date or location, or alternatively claiming a refund. You have the option to seek a refund for the value of the purchased ticket(s) for a postponed event by contacting WBI or the ticketing agent prior to the replacement date for the postponed Event.
8.6 In any case, WBI cannot be held responsible for any resulting costs you may incur for travel, accommodation, any other related goods or service or other compensation.

9. Interruption to our Service
9.1 If it is necessary for us to interrupt our Service, we will give you reasonable notice where this is possible and when we think the down time is such as to justify telling you.
9.2 You acknowledge that our Service may also be interrupted for many reasons beyond our control.
9.3 You agree that we are not liable to you for any loss, foreseeable or not, arising from any interruption to our Service.

10. Disclaimers and limitation of liability
10.1 The law differs from one country to another. This paragraph applies so far as the applicable law allows.
10.2 All implied conditions, warranties and terms are excluded from this agreement.
10.3 The WBI Website includes Content posted by third parties. We are not responsible for any such Posting. If you come across any Content which offends against this document, please email us at lynda@wellbeing-insights.com.
10.4 The WBI Website or Services may contain links to third-party materials that are not owned or controlled by WBI. WBI does not assume any responsibility for any such third-party sites, information, materials, products, or services. If you access a third-party website or service from the WBI Website or Services, you do so at your own risk, and you understand that these Terms and WBI’s privacy policy do not apply to your use of such sites. You expressly relieve WBI from any and all liability arising from your use of any third-party website, service, or content.
10.5 You are advised that Content may include technical inaccuracies or typographical errors. This is inevitable in any website. We would be grateful if you bring to our immediate attention, any that you find.
10.6 We sell Tickets, Courses and other Services in good faith. But we make no representation or warranty that the Event or Course or other WBI products or Services will be:
10.6.1 useful to you;
10.6.2 of satisfactory quality;
10.6.3 fit for a particular purpose;
10.6.4 available or accessible, without interruption, or without error.
10.7 The WBI Website contains links to other Internet websites. We have neither power nor control over any such website. You acknowledge and agree that we shall not be liable in any way for the content of any such linked website or its associated products or services, nor for any loss or damage arising from your use of any such website or its associated products or services.
10.8 The contents on the WBI website, and contents received through WBI’s products or services, are for informational purposes only and are not a substitute for professional diagnosis, medical treatment or therapy. 10.9 WBI and its associates, contractors and employees are not responsible for adverse effects resulting from your use or reliance on any information contained in the WBI Website or Services. We disclaim any obligation or liability to you arising directly or indirectly from information you take from the WBI Website, WBI Events, WBI Courses, or other WBI products or Services.
10.10 You agree that in any circumstances when we may become liable to you, the limit of our liability is the amount you have paid us for your Ticket, Course, or other WBI products or Services. We are not liable for any loss of enjoyment or wasted expenditure. Personal arrangements including travel, subsistence and accommodation relating to the Event which have been arranged by you are at your own risk.

11. Miscellaneous matters
11.1 If you provide us with comments, feedback or testimonials, whether written, verbal or otherwise, you consent to us using this information and or likeness in our marketing collateral. Please note we will not identify you by name unless you have given us permission to do so. Should you wish to revoke any information you have provided us please advise us by contacting admin@wellbeing-insights.com and we will remove reference to your remarks in any future collateral.
11.2 In the event of a dispute between the parties to this agreement, then they undertake to attempt to settle the dispute by engaging in good faith with the other in a process of mediation before commencing arbitration or litigation. If you wish to make a complaint, we ask that you email us at lynda@wellbeing-insights.com. We will take such steps as are reasonable to investigate complaints, within a reasonable time of such complaint being received by us. We will give you a written notice of the investigations, which have been carried out, and the outcome of your complaint.
11.3 If any term or provision of this agreement is at any time held by any jurisdiction to be void, invalid or unenforceable, then it shall be treated as changed or reduced, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from being void and it shall be binding in that changed or reduced form. Subject to that, each provision shall be interpreted as severable and shall not in any way affect any other of these terms.
11.4 If you are in breach of any term of this agreement, we may:
11.4.1 publish all text and Content relating to the claimed breach, including your name and email address and all correspondence between us and our respective advisers; and you now irrevocably give your consent to such publication.
11.4.2 terminate your account and refuse access to the WBI Website, Course or Event;
11.4.3 issue a claim in any court.
11.5 Any obligation in this agreement intended to continue to have effect after termination or completion shall so continue.
11.6 No failure or delay by any party to exercise any right, power or remedy will operate as a waiver of it nor indicate any intention to reduce that or any other right in the future.
11.7 You agree that we may disclose your information including assigned IP numbers, account history, account use, etc. to any judicial or proper legal authority who makes a written request without further consent or notification to you.
11.8 Any communication to be served on either party by the other shall be delivered by hand or sent by first class post or recorded delivery.
It shall be deemed to have been delivered:
if delivered by hand: on the day of delivery;
if sent by post to the correct address: within 72 hours of posting.
11.9 This agreement does not give any right to any third party.
11.10 We are not liable for any failure or delay in performance of any Course or Event for which a Ticket enables, nor for any circumstance beyond our reasonable control.
11.11 The validity, construction and performance of this agreement shall be governed by the laws of New Zealand.
